These Terms of Service (“Terms”) apply to all roofing services performed by California Westmont Roofing (“Company,” “we,” “us”). By hiring us or accepting a service proposal, you agree to these Terms.
1. Scope of Services
We provide roofing inspections, repairs, replacements, installations, emergency services, gutter work, and maintenance.
Final scope of work will be detailed in your written estimate or service contract. Any changes must be documented through a written change order.
2. Estimates, Inspections & Service Agreements
A. Online Estimates Are Preliminary
Estimates requested or viewed on the Site are not final. Actual pricing can only be provided after an on-site evaluation due to variations in:
Roof condition
Structural complexity
Material requirements
Labor needs
Accessibility and safety considerations
B. Final Agreements
A written service contract will outline final pricing, scope of work, materials, project schedules, and payment terms.
Only a signed agreement is binding.
C. No Guarantees from Online Content
Information on the Site is for general reference and does not constitute a contract, warranty, or guaranteed pricing.
3. Payment Terms
Payment terms will be listed in your written proposal. General terms include:
Deposits may be required before work begins.
Progress payments may be required for multi-day or large projects.
Final payment is due upon substantial completion of the work.
Late payments may incur fees and pause project progress.
Materials remain property of the Company until paid in full.
Failure to pay may result in suspension of work or the filing of a mechanic’s lien as permitted by California law.
4. Jobsite Safety Responsibilities
To ensure safety and compliance:
Customers must keep the jobsite clear of personal items, vehicles, or hazards.
Pets and children must remain away from the work area at all times.
Customers must not climb on the roof or enter active work zones.
We reserve the right to pause work if unsafe conditions are present.
Damage caused by customers interfering with the work area is not our responsibility.
We follow OSHA and California safety guidelines during all projects.
5. Limitation of Liability (Service Work Only)
We perform roofing services in a professional and workmanlike manner. However, to the fullest extent permitted by California law:
Our total liability for any claim related to the roofing project will not exceed the amount paid to the Company for that specific project.
We are not responsible for pre-existing damage, hidden defects, structural issues, weather-related events, material shortages, or problems caused by third-party work.
We are not liable for consequential or secondary damages, including interior damage, mold, lost income, or property value changes.
Manufacturer warranties apply only according to their own terms and are not controlled by us.
Customers are responsible for ongoing maintenance after completion of our work.
6. Dispute Resolution
If a disagreement arises out of our services:
Informal Resolution – Both parties will attempt to resolve the matter through direct communication.
Mediation – If unresolved, the parties agree to participate in mediation with a neutral mediator in California.
Arbitration – If mediation fails, the dispute shall be submitted to binding arbitration in California.
Small Claims Option – Either party may choose small claims court when applicable.
Arbitration decisions are final and enforceable.
7. Changes to These Terms
We may revise or update these Terms at any time.
Changes take effect immediately upon being posted on the Site.
Your continued use of the Site signifies acceptance of the updated Terms.
